Expropriation is a legal instrument for efficient urban regeneration, especially when public lands for supplying infrastructure and housing provision may be lacking. However, it should be utilized with a cautious approach since the infringement of individual property rights can be occurred. Moreover, its application and procedure should be related to the national backgrounds intimately, accordingly, theoretical research that compares and analyzes different aspects of each country, has to be carried out continuously for domestic and international perspectives. Therefore, this research focuses on the different continental backgrounds for expropriation in Germany and South Korea, primarily conducts specific case studies for residential redevelopment projects underway up to recently based on three categories: effectiveness, justice, and legitimacy.
